When Blockchain Analysis Meets the Daubert Test
Blockchain analytics claims to be able to overcome the supposed anonymity of blockchain transactions and identify the individuals involved. But when such analytics are brought forward in litigation, can they satisfy the Daubert gatekeeping test for reliable and admissible evidence under Rule 702 of the Federal Rules of Evidence?
Even under the 2023 amendment to Rule 702, which seeks to limit some courts’ overly permissive approaches to Daubert, recent decisions demonstrate that expert-led blockchain analysis can indeed meet the threshold for admissibility in litigation.
